Booking Terms & Conditions

1. Introduction

1.1 These Terms & Conditions (“Terms”) govern your use of all services offered by Capricorn Travel Services Sdn. Bhd. (“Capricorn”, “we” or “us”), including travel planning, booking, and related arrangements (collectively, “Services”).
1.2 By accessing or using any Service you agree to be bound by these Terms. If you do not agree, please do not use our Services.


2. Eligibility

2.1 You must be at least 18 years old and have legal capacity to enter into contracts.
2.2 You warrant that all information you provide is accurate and complete.


3. Booking & Confirmation

3.1 Quotations are valid for 7 days unless otherwise stated.
3.2 A booking becomes firm only upon (a) our written confirmation and (b) receipt of the required deposit or full payment.
3.3 All bookings are subject to availability and to any special terms imposed by suppliers (airlines, hotels, tour operators).


4. Pricing & Payment

4.1 All prices are in Ringgit Malaysia (RM) and include any related tax (if applicable) unless otherwise stated.
4.2 Deposit: You must pay the deposit requested at time of quotation within the timeline given.
4.3 Balance: The balance is due no later than 45 days before departure (or immediately for bookings made within 30 days).
4.4 We accept payment by bank transfer, credit card (plus processing fee up to 3%), or other methods stated during booking.


5. Cancellations & Refunds

5.1 By You:

  • If you cancel more than 45 days before departure, we refund 80% of your payment (20% cancellation fee).

  • 30–45 days before: 50% refund.

  • 0–30 days before: no refund.

5.2 By Capricorn:

  • If we must cancel (e.g. supplier failure), we will offer alternative arrangements or a refund.

  • We are not liable for cancellation due to force majeure (see Clause 12).

5.3 Supplier Fees: Any fees charged by airlines, hotels, or other suppliers are additional and non‑refundable.

5.4 Refund Period: Refund period is subjective to our supplier’s and partner’s refund period and may take up to 3-months.


6. Changes by You (Amendments)

6.1 Requests to change dates, names, or services may incur amendment fees plus any supplier charges.
6.2 Amendments are subject to availability and cannot be guaranteed.


7. Travel Documents & Visas

7.1 You are responsible for obtaining and carrying all valid travel documents (passport, visas, permits, vaccination certificates).
7.2 We are not liable if you are denied boarding, entry, or exit due to improper documentation.


8. Health & Safety

8.1 You must comply with all health, safety, and security requirements imposed by Capricorn, our suppliers, or local authorities.
8.2 We are not responsible for any illness, injury, or loss due to your failure to follow such requirements.


9. Liability & Insurance

9.1 All‑Risk Property Insurance: Capricorn DOES NOT insure your personal baggage or belongings—you must purchase your own travel insurance.
9.2 Public Liability: Capricorn maintains public liability cover for our operations in Malaysia.
9.3 Limitation of Liability: To the fullest extent permitted by law, Capricorn’s total liability for any claim arising out of or in connection with our Services shall be limited to the total fees you paid to us for those Services. We shall not be liable for any indirect, incidental, consequential, or punitive damages.


10. Force Majeure

10.1 Neither party is liable for delays or failures caused by events beyond reasonable control (“Force Majeure”), including but not limited to acts of God, war, terrorism, strikes, natural disasters, or government actions.
10.2 We will endeavor to resume performance once the Force Majeure event ends, and you may choose to reschedule or receive a refund for the affected Services.


11. Intellectual Property

11.1 All content, trademarks, and materials provided by Capricorn are our sole property.
11.2 You may use our materials for personal, non‑commercial use only, retaining all proprietary notices.


12. Privacy & Data Protection

12.1 We collect and process your personal data in accordance with our Privacy Policy [link].
12.2 By using our Services, you consent to our processing of your data for booking, payment, and marketing purposes.


13. Governing Law & Dispute Resolution

13.1 These Terms are governed by the laws of Malaysia.
13.2 Any dispute shall be submitted to the exclusive jurisdiction of the courts of Malaysia.
